Terms of Use

These Terms are the agreement between you and Haivis for accessing and using the Services. By using the Services, you accept these Terms and the policies they reference.

1. Agreement and Service Scope

Haivis provides AI image generation, editing, canvas, project, credit, and related support features. Features may differ by region, account status, technical conditions, or business arrangement.

By accessing or using the Services, you agree to these Terms, the Privacy Policy, the Refund Policy, and any rules expressly incorporated into the Services. If you use the Services for a company or organization, you represent that you can bind that entity.

2. Eligibility, Accounts, and Security

You must meet the minimum age required to use digital services in your jurisdiction and comply with applicable law. Account information must remain accurate, complete, and current.

You are responsible for protecting credentials and for activity under your account. Do not share credentials. Report unauthorized access, compromised credentials, or unusual charges to [email protected] promptly.

3. Acceptable Use and Prohibited Activities

  • Do not use the Services for unlawful, fraudulent, harassing, threatening, discriminatory, privacy-invasive, rights-infringing, or child-harming activity.
  • Do not generate or distribute malware, phishing material, deceptive identities, misleading content, or unverified conclusions for high-stakes decisions.
  • Do not bypass access controls, probe vulnerabilities, scrape or bulk-download service data, abuse free allowances, disrupt systems, upload viruses, or reverse engineer the Services.
  • Do not use another person’s account, payment method, likeness, trademark, or material without the required authorization.

4. User Input, Output, and Content Responsibility

You retain rights in prompts, reference images, files, and other input you submit, and you are responsible for having the permissions needed to process that material.

To the extent permitted by law, Haivis does not claim rights in output generated from your input beyond the rights needed to provide and operate the Services. Outputs may resemble other outputs, and you must assess commercial, likeness, trademark, and copyright risks.

You grant Haivis and its providers a non-exclusive, worldwide, royalty-free, limited license to host, transmit, generate, edit, store, protect, debug, support, and comply with law in relation to your content. This license does not give us ownership beyond those purposes.

5. AI Output Disclaimer

AI outputs may be inaccurate, incomplete, outdated, biased, inconsistent with facts, or unsuitable. Outputs are not professional legal, medical, financial, tax, or other high-stakes advice.

You must review outputs before publishing, selling, advertising, delivering to a client, or using them in a real-world decision. Do not rely solely on output to make decisions affecting an identifiable person’s employment, credit, housing, education, insurance, healthcare, or legal rights.

6. Paid Services, Subscriptions, and Credits

Haivis may offer free features, subscription plans, and one-time credit packs. Benefits, pricing, currency, validity, taxes, and limits are shown on the purchase page or order confirmation.

Credits are used for image generation and related AI operations. They cannot be exchanged for cash, transferred, or used for products not listed on the purchase page. After payment confirmation, entitlements are delivered according to the order rules; report fulfillment issues promptly.

We may change features, prices, plans, or credit consumption rules. Valid benefits already purchased will not be retroactively cancelled without reason, except where required for legal, security, technical, or payment reasons.

7. Cancellation, Suspension, and Termination

If a purchase page offers auto-renewal, cancel through the page or payment channel before renewal. Cancellation generally prevents the next charge but does not automatically reverse access for the period already purchased.

We may restrict, suspend, or terminate accounts or parts of the Services for a breach, suspected fraud or abuse, security risk, non-payment, or legal, technical, or operational reasons.

After termination, access to projects, credits, or history may be unavailable. Export or save content you need in advance; records that must be retained by law may remain stored.

8. Refund Rules

Refund eligibility, deadlines, consumed-credit treatment, duplicate charges, and payment errors are governed by the Refund Policy. Mandatory consumer rights under applicable law are not limited by these Terms.

Refunds generally return to the original payment channel. Where a payment channel has its own dispute or refund process, you must also follow that process.

9. Intellectual Property and Notices

Haivis software, interface, trademarks, visual design, documentation, code, and service orchestration belong to Haivex or its licensors. You may not copy, sell, rent, sublicense, reverse engineer, or build a derivative service except as expressly permitted by these Terms or law.

To report suspected infringement, email [email protected] with evidence of your rights, the location of the material, your contact details, and a good-faith statement. We will handle notices under applicable law.

10. Third-Party Services

The Services may depend on third-party authentication, cloud storage, payment, model, API, analytics, or communication tools. Those services have their own terms and privacy policies; failures, changes, or restrictions may affect Haivis.

You must follow third-party rules when using those services. Except where law requires otherwise, Haivis does not control and is not responsible for the independent content, availability, or processing of third-party services.

11. Availability and Warranty Disclaimer

The Services are provided “as is” and “as available.” We work to keep them reliable and secure, but do not promise uninterrupted, timely, error-free, completely accurate, or purpose-specific results.

We may modify, limit, suspend, or discontinue parts of the Services for maintenance, upgrades, capacity, security incidents, provider changes, legal requirements, or other operational reasons, with notice where reasonably practicable.

12. Limitation of Liability and Indemnity

To the maximum extent permitted by law, Haivis is not liable for indirect, incidental, special, punitive, or consequential loss. Our aggregate liability is limited to the amount you paid Haivis in the twelve months before the event giving rise to liability, except for liability that cannot be limited by law.

To the extent permitted by law, you will defend, indemnify, and hold Haivis harmless from reasonable losses, costs, and claims caused by your breach, unlawful use, infringement, or improper claim by a third party.

13. Disputes, Applicable Law, and Updates

Contact [email protected] first so we can try to resolve a dispute reasonably. Unless mandatory law provides otherwise, disputes will be handled by a court with jurisdiction and applicable mandatory rules.

We may update these Terms as the Services, business, or law changes. Material changes may be notified in the Services, by account email, or by another reasonable method. Continued use means you accept the updated Terms.
